Long wait for primary one laptops to continue as court revokes tender award

The High Court Wednesday nullified the tender awarded to Olive Telecommunications for the supply of laptops to class one pupils.

High court judges Francis Gikonyo and George Odunga ruled that the 4.6 billion shillings contract was awarded unprocedurally and further directed that the tendering process begins afresh.

Olive Telecommunications of India was reported to have won the bid to supply 1.3 million laptops for Standard One pupils.

However, the Public Procurement review board cancelled the contract awarded to Indian firm, Olive Telecommunications PVT Ltd, on the grounds that the company did not meet the financial requirement set in the tender document, and was not an original equipment manufacturer.

Olive Telecommunications promptly moved to the High court to challenge the board's decision. The court then stopped the project early this year.

The firm argued that the board annulled their tender award without giving them a fair hearing, a dispute that was dismissed by the trial court when it ruled that they were given a fair hearing.

The court held that the Board over exercised its mandate when it annulled the tender adding that their ruling is meant to promote equity and cost effectiveness in the tendering process.
