The High Court in Kerugoya has reinstated Martin Wambora as Embu Governor.
An order by judges Hedwig Ong’udi, Cecilia Githua and Boaz Olao will remain in force until a case filed by Wambora challenging his impeachment is heard and determined.
The case is due for hearing on Monday next week. Wambora’s removal from office was set in Motion by the Embu County Assembly and culminated in an impeachment vote at the Senate last Friday.
The Senate found him guilty of violating public procurement and public finance management laws as well as the Constitution.
Meanwhile, his deputy Dorothy Nditi has already assumed office after the Senate absolved her of any wrong doing.
Thirty-nine Senators voted to impeach Wambora but Embu Senator Lenny Kivuti abstained from the historic vote as Baringo Senator Gideon Moi voted ‘no’ on all counts.
The 39 agreed that the embattled Governor violated the Public Procurement and Disposal Act 2005 (PPDA) and PPDA Regulations2013, the Public Finance and Management Act and the Constitution.
The charges of abuse of office and violation of the County Governments Act 2012 made against the Embu Governor were, however, found not to have been substantiated by the Senate team.
In his defence, Governor Wambora maintained his innocence but remained adamant that there was malice in the manner in which the County Assembly handled the impeachment Motion.
